Crosscheck Duty — Terms of Use

These Terms of Use ("Terms") govern your use of the Crosscheck Duty & Rest app ("the app"), published by GJU Software LLC ("we", "us"). By downloading or using the app you agree to these Terms. If you obtained the app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies; if these Terms conflict with it, these Terms apply to the extent allowed.

1. What the app is

The app is an informational calculator that shows federal flight-duty and rest limits for US Part 121 passenger operations under 14 CFR Part 117 and 14 CFR §121.467. It is not a legality determination. It does not replace the regulations, FAA guidance, your certificate holder's procedures, your collective bargaining agreement, or crew scheduling. You remain responsible for confirming every limit and for your fitness for duty. The app is not affiliated with the FAA, any airline or any labor organization.

2. Subscription and free trial

• Full use of the app requires a yearly auto-renewing subscription. New subscribers may receive a free trial; its length and the price are shown in the app and in the store before you confirm.
• Payment is charged to your Apple Account or Google Play account when you confirm the purchase, or at the end of the free trial if one applies.
• The subscription renews automatically each year at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
• If you cancel during a free trial, you are not charged. Any unused part of a free trial is forfeited when you purchase a subscription.
• Manage or cancel the subscription in your Apple Account or Google Play account settings. Deleting the app does not cancel it.
• Refunds are handled by Apple or Google under their policies; we cannot issue store refunds directly.
• We may change the price with notice as required by the store; a price change applies from your next renewal.

3. Licence

We grant you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control, for your own use, subject to these Terms and the store's usage rules. You may not copy, modify, reverse-engineer, resell or redistribute the app, except as the law allows.

4. Accuracy, no warranty

We work to keep the calculations accurate and current with the regulations, but regulations, interpretations and operations change, and errors are possible. The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement, to the fullest extent the law allows.

5. Limitation of liability

To the fullest extent the law allows, GJU Software LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from reliance on the app's results, including disciplinary, regulatory or employment consequences. Our total liability for any claim relating to the app is limited to the amount you paid for the app in the 12 months before the claim.

6. Privacy

7. Changes and termination

We may update these Terms; the updated version will be posted at this address with a new date, and continued use means you accept it. We may suspend or end access to the app if you breach these Terms.

8. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, except where your local consumer law gives you rights that cannot be waived.
